Urgent Call from International Lawyers in Support of the Launch of a Diplomatic Humanitarian Convey to break the Siege of Gaza

Famine has been declared in Gaza. Palestinian civil society and allied institutions have issued a unified call for the deployment of a diplomatic humanitarian convoy to break the siege of Gaza. This is a simple request, urging states to commit to sending a diplomatic convoy in adherence to their international legal obligations. The more states that join this commitment, the greater the likelihood that this tactic of diplomatic pressure will succeed.

We, the undersigned international lawyers and legal scholars and practitioners, endorse the urgent and unified demand issued by over 1,000 civil society organisations: The deliberate starvation of Gaza’s civilian population constitutes a grave violation of international law and must be halted immediately. The international community has a legal and moral obligation to act decisively by launching a diplomatic humanitarian convey to break the siege of Gaza.

The facts before us are clear and incontrovertible. Since 2 March 2025, Israel has imposed a total blockade on Gaza, cutting off all humanitarian supplies—the longest and most severe siege in the territory’s history. As documented by UNICEF, OCHA, UNRWA, and the World Food Programme Gaza’s farmland has been destroyed, fishing waters are inaccessible, bakeries and community kitchens have shut down, and hospitals lack even basic supplies. 92% of children under two and breastfeeding mothers face acute malnutrition, while famine-related deaths are already occurring.

This is not a crisis of scarcity but of enforced deprivation. Over 3,000 aid trucks and 116,000 metric tonnes of food stand ready at Gaza’s borders, obstructed solely by Israel—an act of collective punishment, and weaponisation of aid in direct violation of:

  • The Geneva Conventions (Article 55 of GCIV, prohibiting starvation of civilians);
  • The Rome Statute (Article 8(2)(b)(xxv), defining starvation as a war crime);
  • The ICJ’s provisional measures in South Africa v. Israel (26 January 2024), calling for unhindered delivery of aid;
  • The ICJ’S Advisory Opinion on the Legal Consequences of the Israeli Occupation of the Palestinian territories (9 July 2024) ascertaining that Israel does not have any lawful authority in Gaza, and that it cannot justify violations of international law under the prism of security concerns.

Instead of ending the illegal blockade and continued aggression identified by the ICJ as a plausible genocide, Israel and the US are proposing to take exclusive control over the distribution of aid in Gaza, deploying Private Military Contractors to oversee the operations. This proposal is in violation of the core principles of neutral, impartial and independent aid delivery, the Palestinian people’s right of self-determination, the rules of occupation – and facilitates wider forms of collective punishment, and the use of starvation as a method of warfare. 

The UN Secretary-General and High Commissioner for Human Rights have repeatedly reiterated that third states bear positive obligations under international law to ensure compliance. These obligations are premised on the duty to prevent genocide, cooperate to end grave illegalities, and to protect the Palestinian people. To fulfil their obligations, states and political representatives must act urgently towards:

  1. Diplomatic Humanitarian Convoy: We call on all states to deploy official diplomatic missions to accompany aid trucks into Gaza via Rafah.
  2. Unhindered Aid Access: States must coordinate with Egypt and the UN to guarantee safe passage for humanitarian convoys, rejecting Israel’s militarization of aid distribution.
  3. Individual Diplomatic Action: Where governments refuse to act, we urge parliamentarians, jurists, and diplomats to join the convoy in their personal capacities, to uphold the international community’s ethical and legal responsibilities.
  4. Media and Civil Society Mobilization: Legal professionals, journalists, and human rights monitors must document violations to ensure accountability for starvation crimes and counter misinformation.

Participating in the effort represents the bare minimum threshold of responsibility. States must also work towards imposing a three-way arms embargo against Israel, multilateral efforts to unseat Israel from the UN General Assembly, terminate trade relations with Israel which sustain and further entrench its illegal occupation, halt diplomatic relations with Israel, and facilitate and support legal proceedings against perpetrators of atrocities.

Every hour of delay accelerates the atrocities that Israel is perpetrating against Palestinians, and erodes the possibility of justice being obtained through international law.
